Terms of Service

Welcome to Fairy Forest Designs. By accessing or placing an order on our website, you agree to be bound by these Terms of Service (“Terms”). Please read them carefully.

1. Overview

Fairy Forest Designs offers custom graphic design products, including apparel, décor, gifts, and business items. Many of our products are made-to-order and personalized.

2. Custom Orders, Design Approval & Cancellations

Custom and personalized items are created specifically for you.

A design proof will be provided for your review. Production begins only after you approve the final design.

You are responsible for carefully reviewing all design proofs for accuracy (spelling, colors, layout, sizing, etc.) before approval.

Your purchase includes up to three (3) rounds of design revisions. Additional revisions beyond the three included rounds may be subject to additional charges. We will notify you in advance if further revisions will incur extra fees before proceeding.

You may request to cancel or make changes to your order before the final design is approved.

Once we have begun creating custom artwork for your order, any cancellation may be eligible for only a partial refund. The refund may be pro-rated to account for the design time and creative effort already invested.

After you approve the final design and production has started, the order is considered final and cannot be cancelled. No refund will be issued except as provided in our Return Policy for damaged or defective items.

3. Pricing & Payment

Prices are listed in U.S. dollars and are subject to change.

Payment is processed securely through PayPal.

Full payment is required at the time of order (or as otherwise indicated at checkout).

4. Shipping

We ship within the United States only.

Shipping costs are paid by the customer.

Production begins after final design approval and typically takes 4–7 business days, subject to material availability.

Risk of loss transfers to you once the package is handed to the carrier. We strongly recommend purchasing shipping insurance.

5. Returns & Refunds

Due to the custom nature of our products, all sales are final except in cases of damage or manufacturing defects. Please see our full Return Policy for details.

6. Intellectual Property

All designs, graphics, and content on this site are owned by Fairy Forest Designs or used with permission.

When you submit content or request a custom design, you grant us the right to use that content solely to fulfill your order.

You represent that any materials you provide do not infringe on third-party rights.

7. Limitation of Liability

To the fullest extent permitted by law, Fairy Forest Designs shall not be liable for any indirect, incidental, or consequential damages arising from your use of the site or products. Our total liability is limited to the amount you paid for the applicable order.

8. User Conduct

You agree not to misuse the website, attempt unauthorized access, or submit content that is unlawful, infringing, or harmful. You may not upload, submit, request, or provide any content (including text, images, logos, designs, or other materials) that:

• Is illegal under applicable law
• Infringes on the intellectual property or other rights of any third party
• Depicts or promotes child sexual abuse material or any sexual content involving minors
• Contains threats, harassment, hate speech, or promotes violence or illegal activity
• Is defamatory, obscene, or otherwise harmful
• Violates the privacy or publicity rights of any person

Fairy Forest Designs reserves the right, at our sole discretion, to:

• Refuse or cancel any order
• Reject or remove any submitted content
• Suspend or terminate your ability to place future orders

We may report illegal content or activity to law enforcement authorities and cooperate fully with any resulting investigation. By submitting content to us, you acknowledge that we may disclose relevant information (including your contact details and the submitted materials) to law enforcement when we believe in good faith that such disclosure is necessary or required by law.

You agree to indemnify and hold Fairy Forest Designs harmless from any claims, damages, or expenses arising from content you submit that violates these terms or applicable law.

9. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.

10. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised date. Continued use of the site after changes constitutes acceptance of the new Terms.
